Legal Ethics and How the Ethical Rules Apply to Non-Attorneys

This interactive presentation will provide an overview of the Colorado Rules of Professional Conduct and how these rules apply to non-attorney staff at Colorado Legal Services. The panel will discuss how the Rules of Professional Conduct are applied in: intake, communications with third parties and partner agencies, written communications to clients, and in considering how to respond when we have concerns for the safety of our clients or others. In considering the work of non-attorneys, the panel will specifically focus on the following rules: 1.6, 1.18, 4.3, 5.3, 5.5, and 7.3. This presentation is designed for attorneys, supervisors, paralegals, intake specialists, and administrators. All are welcome.

Through processes laid out in laws including the Freedom of Information Act and Colorado Open Records Act, attorneys can obtain records and information from government agencies, which can help with investigations and advocacy on behalf of CLS’s clients. You have prepared your case for hearing and have your arguments drafted and ready to go and your witnesses prepared, but how will your presentation actually be received by the trial judge? Hear from a former CLS staff attorney and current District Court Judge about the most effective and least effective practices in the courtroom from the perspective of the bench. Topics addressed will include telling your client’s story via direct testimony, when and how to object in the most effective manner, cross-examination, impeachment, time limits, marking and admitting exhibits, dealing with difficult opposing counsel, limited entry and when counsel can be most effective, the most critical evidentiary rules in domestic relations cases, and the weight of CFI, PRE, and expert testimony. The presenters will discuss these topics and more in a guided Q&A format and scenarios focused on CLS and our clients. More focus will be on litigating family law cases but anyone handling cases in state court should bring their questions and leave with helpful information.

Led by Gail Rodosevich, Colorado Legal Services (CLS) Statewide PAI Coordinator, this session will explore how PAI programs and pro bono volunteers complement CLS offices and maximize staff attorney time. It will present key PAI statistics, including the dollar value of pro bono contributions, and highlight the benefits for underserved communities across Colorado. The presentation will also focus on expanding current PAI programs and introducing new service delivery models planned for 2025. These innovative approaches are designed to increase access to justice, especially in rural and underserved areas, by leveraging creative partnerships and technology. Additionally, it will propose the creation of a statewide panel of contract attorneys, discussing how this strategy could enhance CLS’s effectiveness in closing the justice gap. The session will conclude with a panel discussion for further insights and audience questions.

Objectives:
  1. Explore the role and impact of PAI programs in expanding access to justice.
  2. Highlight the financial and societal value of pro bono attorney contributions.
  3. Discuss strategies for expanding PAI programs and new 2025 service delivery models,focusing on rural outreach.

In Her Shoes: An Experiential Learning Opportunity About Domestic Violence

The guest speakers will be Kristeen O’Donnell and Maegan Brundage from CLS’s Client Support Services team. They will present the Washington State Coalition Against Domestic Violence experiential learning activity called In Her Shoes: Living with Domestic Violence. Participants will move through scenarios based on real DV stories, choosing their own paths to “walk a mile in her shoes”.

Each participant receives a character card and must find stations (like Abuse Happens, Clergy, DV Advocate, Medical, Return Home, Funeral home) randomly scattered throughout the conference room, mimicking the frustration of finding and utilizing community services. Participants will find stations where they are given choices in how to proceed and will follow their character’s story to the end. Maegan and Kristeen will then conduct a debrief – the most critical part – which will increase awareness and empathy by showing that intimate partner violence is a community tragedy, illustrating that we all have a role in ending violence and thinking creatively about our roles day to day. Participants will find that people experiencing abuse constantly want and try to stay safe, but many systems, institutions, and people make it difficult.

Through an interdisciplinary lens, a social worker and a lawyer will define capacity and professional standards for best practice, identify client red flags, and provide an ABA-approved tool for working with diminished capacity. Small group case study discussions allow attendees to practice implementing the tool and to learn from peers. The speakers will provide attendees with a hypothetical fact pattern based on a client story that is common to CLS. The hypothetical will involve multiple legal issues that are common for low-income consumers and attendees will need to issue spot the legal issues to be addressed. The presenters will then discuss each legal issue individually and assess with the attendees the best legal action to take depending on the relevant consumer law. Issues that may arise include mortgage issues, wage garnishment issues, personal property garnishment, exemptions, collections lawsuit, and whether or not the client should file for bankruptcy.

The speakers will be Kathryn Hall, Managing Attorney of CLS’ Greeley office, Calleigh Durr, Assistant Supervising Attorney of the Colorado Springs Consumer Protection and Public Benefits Unit, and Michelle Smith, staff attorney in the Denver’s Health and Elder Law Unit. They will provide an overview of the Old Age Pension benefit, recent regulatory and statutory changes to the benefit, and the resulting legal issues. They will discuss updates to other benefits including food assistance and Medicaid. They will give a brief overview of Social Security policy changes related to overpayments. Last, they will discuss income and resource considerations as it relates to other areas of law, and where to locate public benefit resources on SharePoint.
